4. Entry Requirements and Content Standards
Each entrant represents and warrants that their entry:
- is original and created by the entrant;
- does not infringe any intellectual property, privacy, publicity, image, personality or other third-party rights;
- does not include any content that is defamatory, obscene, offensive, discriminatory, unlawful, unsafe, misleading, harmful to the Promoter's brand or otherwise inappropriate;
- complies with all applicable laws, regulations and platform rules;
- does not include third-party branding, music, artwork, people or locations unless the entrant has obtained all necessary rights and permissions; and
- does not contain any health, biometric, fitness or location data other than permitted performance data: such as step count, time, pace and distance.
The Promoter reserves the right to reject or disqualify any entry that, in the Promoter's reasonable opinion, breaches these Terms and Conditions or may expose the Promoter to legal, regulatory, reputational or operational risk.
5. Step Count and Performance Data
Where step count or similar performance proof is required under Schedule 1, the only permitted performance data is the entrant's step count recorded by a personal fitness device or smartphone application during the relevant festival or event. Step count or similar basic performance information will be used only for verification and judging purposes in connection with the Competition. It will not be used to assess entrants' health, fitness, medical condition or physical condition.
Entrants are responsible for ensuring that their submissions only include information required for the Competition. When performance proof is submitted, entrants must crop, blur, cover, draw over or otherwise obscure any information that is not required, including heart rate, blood pressure, sleep data, calorie data, medical data, GPS location history or precise location information, or other detailed health, biometric or sensitive information.
The Promoter will, prior to resharing any submission or capturing performance proof, blur, crop, cover, draw over, or otherwise obscure any information that is not required for the purposes of the Competition. The Promoter will only process information necessary to verify the participant's performance for the Competition. Any unnecessary information included in a submission will not be used for Competition purposes.
By submitting an entry, entrants confirm that any step count and/or performance data shown is their own, was recorded during the relevant festival or event, and has not been altered, falsified or manipulated.
The Promoter may request reasonable supporting evidence to verify step count and/or performance data, eligibility or compliance with these Terms and Conditions, but is not required to do so.
6. Judging, Finalists and Winner Selection
Valid entries will be reviewed by representatives of the Promoter and/or its appointed partners. Entries will be judged against the criteria and weighting set out in Schedule 1. Chance will not determine the winner.
Engagement metrics such as likes, views, comments or shares may be considered only where stated in Schedule 1 and will not be determinative. The Promoter may disqualify entries where engagement appears artificially inflated, manipulated, purchased or otherwise inauthentic. Some entries may be reshared by Promoter's social media accounts during the duration of the competition. This does not automatically mean that the reshared content or entries are winners. Entries without a reshare are also eligible.
The number of finalists and the selection timetable are set out in Schedule 1.
Finalists and the winner may be required to confirm eligibility, identity, availability and acceptance of the applicable terms before any prize is awarded.
If a finalist or winner is ineligible, cannot be contacted, does not respond within the timeframe specified by the Promoter, refuses the prize or fails to comply with these Terms and Conditions, the Promoter will select an alternative finalist or winner.
The Promoter's decision is final, subject always to applicable mandatory law.
7. Prize
The prize is described in Schedule 1. The prize is non-transferable, non-exchangeable and no cash alternative is available, except where expressly stated in Schedule 1 or required by applicable law.
Where the prize includes travel, accommodation or event access, the winner and their guest must comply with all travel, venue, event and ticketing rules.
The winner and guest are responsible for obtaining valid passports, visas, travel authorisations, insurance and any other documentation or requirements necessary to travel and attend the event.
The Promoter may provide reasonable support, such as invitation letters, but cannot guarantee visa approval, travel permission, event admission or uninterrupted event access.
If the winner cannot travel, attend or accept the prize for any reason, the Promoter has the right to select an alternative winner.
7.2 Companion
The winner may nominate one companion aged 18+ who satisfies the same eligibility and travel requirements and must have exactly the same travel and stay plan as the winner. The winner is responsible for the companion's compliance with these Terms.
8. Promotional Participation
- Finalists and the winner may be invited to participate in promotional activities connected with the Competition, including content creation, interviews, social posts, event appearances and campaign storytelling.
- Participation in additional promotional activities is voluntary unless separately agreed in writing.
- Any additional content creation, ambassador activity or paid promotional engagement may be subject to a separate agreement.
- Nothing in these Terms and Conditions creates an employment relationship, agency relationship, partnership, endorsement contract or ongoing service arrangement.
9. Rights in Entries and Publicity
By entering, entrants grant the Promoter and its group companies a worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, publish, edit, adapt, display, distribute and communicate their entry, name, social media handle, image, likeness and voice for the purposes of administering, promoting and reporting on the Competition and the Hydro:Ice campaign.
This licence includes use on organic social media, paid media, advertising, PR, press materials, owned channels, partner channels and internal materials.
The Promoter may crop, edit, subtitle, translate, reformat or otherwise adapt entries, provided the meaning is not materially distorted.
Entrants waive, to the fullest extent permitted by applicable law, any moral rights or similar rights that would prevent the Promoter from using entries as permitted under these Terms and Conditions.
Entrants are responsible for ensuring that any person appearing in their entry has consented to the entry and to the uses described in these Terms and Conditions.
10. Data Protection and Privacy
For the purposes of applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679, the Promoter will act as controller of the personal data processed in connection with the Competition, unless otherwise stated in the applicable privacy notice.
The Promoter may process personal data including the entrant's name, contact details, age or date of birth where needed to verify eligibility, country of residence, social media handle, public entry content, image, likeness, video, communications with the Promoter, eligibility and identity verification information where required, including for finalists or potential winners before any prize is awarded, prize fulfilment information, step count or other basic performance information required for the Competition, and any other information reasonably necessary to administer the Competition.
Personal data will be processed for the purposes of administering the Competition, receiving and reviewing entries, judging entries, verifying eligibility, contacting entrants, selecting and announcing finalists and winners, fulfilling the prize, arranging travel or event access where relevant, managing legal or regulatory obligations, preventing fraud or misuse, handling queries or issues relating to the Competition and carrying out related promotional activities.
Step count or similar basic performance information will be used only as a competition performance indicator for verification and judging purposes. It will not be used to assess entrants' health, fitness, medical condition or physical condition, and no automated decision-making or profiling based on this information will take place.
Entrants should not include heart rate, blood pressure, sleep data, calorie data, medical information, GPS route history or other detailed health, biometric or location data in their submissions. Where performance proof is submitted, entrants must follow the requirements set out in Schedule 1.
The legal bases for processing may include performance of the Competition terms, compliance with legal obligations, the Promoter's legitimate interests in operating, promoting and protecting the Competition and its brands, and consent where required by applicable law, for example for certain promotional uses or marketing communications.
Personal data may be shared with The Magnum Ice Cream Company group companies, agencies, service providers, prize fulfilment partners, travel providers, event partners, professional advisers, authorities and other partners involved in operating the Competition, delivering the prize, complying with legal obligations or protecting the Promoter's rights. Where personal data is transferred outside the European Economic Area or the United Kingdom, appropriate safeguards will be applied in accordance with applicable data protection laws.
Personal data will be retained only for as long as reasonably necessary for the Competition, prize fulfilment, publicity, record-keeping, legal compliance and related administrative purposes, unless a longer retention period is required or permitted by law.
Entrants may have rights in relation to their personal data, including the rights to access, correct, delete, restrict or object to certain processing, request data portability, withdraw consent where processing is based on consent, and lodge a complaint with a competent data protection authority, subject to applicable law.
For more information about how personal data is processed, collected, used, shared, transferred and retained, and how entrants can exercise their rights, please see the Promoter's Global Privacy Notice: Privacy Notices | The Magnum Ice Cream Company. The contact point for privacy-related questions is privacy.office@magnumicecream.com. Country-specific privacy terms may apply where required by applicable law.
11. Platform Terms
Entries must comply with the terms, policies and community guidelines of the social media platform(s) used to enter. The Competition is not sponsored, endorsed, administered by or associated with TikTok, Instagram, Meta Platforms, Inc. or any other platform unless expressly stated otherwise.
The Promoter is not responsible for entries that are lost, removed, restricted, de-amplified, blocked, made private or otherwise unavailable due to platform settings, moderation, technical issues or entrant error.
12. Liability and Indemnity
Nothing in these Terms and Conditions excludes or limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded or limited under applicable law.
Subject to the above, the Promoter will not be liable for indirect, special, incidental or consequential losses, loss of opportunity, loss of profit, loss of reputation, technical failures, platform failures or events outside its reasonable control.
The Promoter's total liability to any entrant in connection with the Competition will not exceed the value of the prize described in Schedule 1, subject always to applicable mandatory law.

13. Modification, Suspension and Cancellation
The Promoter may modify, suspend or cancel the Competition where necessary due to circumstances outside its reasonable control, legal or regulatory requirements, fraud, technical issues, platform changes, safety concerns or operational reasons that materially affect the fair or proper running of the Competition.
